VAPP LAW: U.I.T.H ADMIN STAFF AND CJ'S STEP-SISTER FACE CRIMINAL CHARGES TODAY

The case of criminal assault, domestic violence, reckless driving, mischief, contempt of court, and public disturbance against Mrs. Hameedat Oluwakemi Ajadi, a Senior Admin Officer at the University of Ilorin Teaching Hospital(UITH) and step-sister to the Chief Judge of Kwara State, comes up today before Senior Magistrate M.D. Dasuki, in Ilorin, Kwara State capital.



The Publisher of Kwara People Magazine, and Coordinator, VAPP LAW AWARENESS CAMPAIGN, Ilorin, Hon. Abdul-Hameed Oladipupo Alli has dragged his ex-wife, Mrs. Hameedat Oluwakemi Ajadi, and former Kwara State Grand Khadi, Justice S. O. Mohammed (retired),  to the state Magistrate Court for alleged violence, incitement, and disobedience of Court orders.


Others being dragged before the Court are Mrs. Muslimat Nagode, a Counsel in the state Ministry of Justice, and DSC Tiamiyu Ismail, an officer in the Nigeria Security and Civil Defence Corps (NSCDC), Kwara state Command.






The cases which were filed separately as a direct complaint under the Violence  Against Persons Prohibition (VAPP)  Law 2020 and domesticated by the Kwara state government.


Alli, a former TIC Chairman of Ilorin West Local Government,  in a suit filed against his ex-wife alleged that Hameedat violently abused him, engaged in reckless driving to assault him thereby causing a public disturbance, contrary to sections 2(1),2(2),4,11,13,14,26,34 of Violence Against Persons Prohibition (VAPP) Law domesticated already domesticated in Kwara state.


In another suit, Alli alleged retired Justice S.O. Mohammed, of inciting, aiding, and concealing his ex-wife to disobey the order of Upper Area Court (I), Ilorin on the divorce Suit filed against Hameedat delivered on December 10, 2020, contrary to sections 2(3),2(4),3,6,13 and 34 of VAPP. 


He said that the retired Grand Khadi who was requested to interpret the law to the Couple particularly his ex-wife from disobeying the Court orders granted in the divorce Suit failed to do so and joined her in forging a fake letter against him purportedly addressed to the court against him that he has disowned his children.


As for Barr. Muslimat Nagode and Mr. Tiamiyu Ismail, the Civil Defence officer, Alli said that they allegedly incited, aided, and concealed his ex-wife to commit an act of violence as well as coercing her to engage in acts detrimental to his physical and psychological well-being contrary to sections 2 (3),2(4),3,6,13 and 34 of VAPP domesticated in Kwara state.


Alli in the suit said that Hon. Abdulganiyu Mustapha, a judge of the Upper Area Court granted a divorce between him and his wife in a judgment delivered on December 10, 2020, in which he granted his wife the custody of their two children while he (the husband and father of the children) should be allowed to have access to the children two times a month.


The Court also said that both parents should agree on the school that the children would attend while the husband should be responsible for the payment of school fees and give N12,000 to their mother monthly for the upkeep of the two children.


Alli however said that contrary to the Court orders, his ex-wife prevented him from seeing the children while she deliberately changed the school which the children were attending to four different schools without making it known to him contrary to the Court Order.


He said that he filed a suit for the enforcement of the Court orders on December 24, 2021, in the same Court where the orders were given but the suit was not listed for hearing as a result of what he termed as "obstruction by some of those judges and staff of the judiciary who seem to be afraid of doing their constitutional duty in exchange for seeking favour of his ex-mother in law, Hajia Nusiratu Kawu, who incidentally is a stepmother to the Chief Judge of Kwara State, Justice Durosinlohun Kawu.


He alleged that his ex-wife took to violence by attacking him at the premises of a Central Jumaat Mosque at Irewolede where he took refuge and she inflicted injury on him and damaged his car.


"Just recently, my ex-wife, Hameedat threatened to kill me and even called my mother in far away Lagos and my uncle named Mr. Rafiu Folarin Alli here in Ilorin with threatening messages that she would afflict me with spiritual attack or Juju if I don't stop asking after the children", he stated in the suit.


He alleged that the former Grand Khadi S.O. Muhammad whom he called to intervene in noncompliance in the Court judgment by his ex-wife as a religious and respected community leader deceived him and took him to the Chief Judge of the state who is a stepson to the mother of his ex-wife and there and then, the Honourable CJ who was expected to direct his step sister to obey the Court Order, rather advised him to forget about his children for some years, that the ex-wife would start running after him with them when he fully knew that the children are still in their formative ages and that their mother is trying to relocate them to her twin sister in USA, an effort thwarted by the publisher turned politician who put a call through to the American Embassy not to grant any Visa Applications for his children without confirming any convent letter presented by their mother from him. It was the refusal of the Embassy to issue CJ's step-sister entry Visa to the USA, despite her American-based twin sister's green card status and other powerful supporting documents, that led to Hajia Kawu, Hameedah's mother, and Mr. Bola Ajadi, her father, to declare fight to finish against their ex-son in law, whom they said will never be allowed to see his children again for stopping the relocation and humiliating them through their daughter's refusal of Visa despite their status and one of her uncles being a Nigeria's former Diplomat to USA, an allegation which the publisher has denied that he only asked the Embassy not to grant visas to his children and not their daughter. He said that it was due to their desperation that the retired grand Kadi allowed himself to be used to be part of the letter forged to Court which the retired juri personally handed over to the publisher and asked him to send a reply to him instead of the court which he said has compromised. The total regard Alli has for the retired grand Kadi made him to reply him in a seven pages letter which contained all the illegalities conducted by the ex-wife instead of his thought that what both the CJ and himself told the publisher to forget about the children would make him reply in the same manner but the reply spoiled their businesses which they would have successfully presented the letter at the Embassy to facilitate Visa application for my children and their daughter.


He also accused Musilimat who despite not being a party to the suit he instituted on the Court judgment to compel his wife to release his children to visit him alleged that she prevented him from having access to his two children 


"Earlier, sometime in February 2020, one Barrister Muslimat Nagode who introduced herself as a state Counsel harassed, humiliated, and forcefully usurped my children from me in the premises of the Upper Area Court 1, Ilorin when the trial judge, Hon. Abdulganiyu Mustapha ordered their mother and my ex-wife to bring them to the Court in favour of my prayers in the previous week."


He also alleged that the Civil Defence officer failed to take any action when he reported that his ex-wife assaulted him and damaged his car.


Alli said that he wrote a petition to the Chief Judge of the state Judiciary, Justice Suleiman Kawu on the alleged atrocities especially the disobedience of the Court judgment by his ex-wife which he said was being instigated by some powerful people in the state Judiciary but received no response from the judicial officer.


Alli however prayed the court to prosecute his ex-wife for alleged disobedience of the Court orders and alleged violence and attack on his person and damage to his car contrary to VAPP Law domesticated in Kwara state and award him compensation by section 26 and other relevant sections of VAPP Law under compensation for victims.


He also urged the Court to prosecute the former Grand Khadi, Muslimat Nagode, and Tiamiyu Ismail, an officer of the Civil Defence Corps for allegedly inciting, aiding, and counseling Hameedat, his ex-wife to disobey Court orders and committing an act of violence as well as coercing her to engage in acts detrimental to his (husband) health.


While the suit with number MCIA/924c/2022 filed against his ex-wife was assigned to Magistrate M.D. Dasuki, comes up on Monday 31 October 2022, the suit marked MCIA/925c/2022 was allocated to Magistrate M. F.  Adebola, against Justice S.O. Muhammad, and has been moved for transfer to another judge as the Magistrate refused to serve Summons to the retired Grand Kadi. Similarly, Chief Magistrate Adeniyi has directed the Police to investigate the suit against both Nagide and Tiamiyu and the State CID has invited them through their establishments respectively.


Meanwhile, Alli has written another petition to the Chief Judge with a copy submitted to the Secretary, of the Judicial Service Commission, where he accused the trial judge, Him. AbdulGaniu Mustapha, of conspiring with his ex-wife by not ordering her to bring the children to court for him to have access on the last Friday of October. Though the court issued a summon for their mother to be in court on Thursday 27th October 2022, when she was expected to produce them in court the following day, it was surprising that the judge announced that he was transferring the case that has already been concluded to another judge when there was no application for enforcement before the court. A reliable source confirmed that the judge might have been threatened again by either the second in command to the Chief Judge, Hon. Justice Titi Daibu or the stepmother of the CJ herself who has the habit of addressing herself as either My Lord or Iya CJ, Hajia Nusiratu Kawu. Should this continue in the state judiciary, I want the Kwara State Governor, Mallam Abdulrahman Abdulrazaq, the First Lady, Ambassador Dr. Olufolake AbdulRazaq, the Emir of Ilorin, Dr. Ibrahim Sulu Gambari, to be notified that the judiciary which is expected to be the last hope if the common man is no doubt inciting anarchy as I might result to self-help to seek justice if pushed to the wall because, despite Police SIB Report indicting her, the courts continue shielding her because she is CJ's step sister at the detriment of equity, fairness, and justice.


When contacted, the Chief Registrar of the state High Court, Mrs. Ibidun Olawoyin said that she was ignorant of the petition written by Alli to the Chief Judge on the alleged blocking of his suit on the execution of the Court judgment and advised him to file an appeal at the higher Court.


She said, "Honestly, I'm in the dark about this matter but if actually, he wants justice in the matter, he should file an appeal to the higher Court adding that the Upper Area Court is not the last in the suit, he should go to higher Court to file appeals.
